RushTxt Terms & Conditions

These Terms & Conditions govern use of the RushTxt messaging platform operated by Trcked Up LLC dba RushTxt. RushTxt enables participating businesses to communicate with customers using SMS, WhatsApp, Instagram Direct Messaging, and other supported messaging channels.
1. Program Description
RushTxt allows participating merchants to communicate with customers regarding orders, customer support, receipts, promotions (where consent has been provided), loyalty programs, and related transactional communications using SMS, WhatsApp, Instagram Direct Messaging and other supported messaging platforms.
2. Eligibility
You must be at least 13 years old to use RushTxt. If you are under 18, you must have permission from a parent or legal guardian.
3. Consent
By initiating or participating in a conversation with a merchant through RushTxt, you authorize the merchant and RushTxt to communicate with you using the messaging channel you selected. Consent is not a condition of purchase.
4. Message Frequency
Message frequency varies based on your interaction with the merchant, including orders, customer service requests, account activity and optional marketing communications where you have opted in.
5. SMS Terms
Message and data rates may apply for SMS depending on your mobile carrier. Reply STOP to unsubscribe from SMS and HELP for assistance.
6. WhatsApp and Instagram
When using WhatsApp or Instagram Direct Messaging, your communications are also governed by Meta's applicable Terms of Service and Privacy Policy. You may stop communicating with a merchant, block the account, or use available platform controls at any time.
7. Merchant Communications
RushTxt may deliver transactional messages including order confirmations, order status updates, pickup notifications, receipts, customer service responses, and other communications necessary to fulfill your interaction with the merchant.
8. AI-Assisted Conversations
RushTxt may use artificial intelligence to assist in understanding requests, answering questions, translating conversations, recommending menu items, and facilitating orders. Merchants remain responsible for their products, pricing, availability and fulfillment.
9. Privacy
Your use of RushTxt is subject to the RushTxt Privacy Policy.
10. Intellectual Property
RushTxt software, trademarks, logos and related content remain the property of Trcked Up LLC or its licensors.
11. Limitation of Liability
To the fullest extent permitted by law, RushTxt shall not be liable for indirect, incidental, consequential or special damages arising from use of the platform, messaging services, or merchant products and services.
12. Third-Party Services
RushTxt integrates with third-party services including messaging providers, payment processors, point-of-sale systems and cloud providers. Their separate terms and policies also apply where relevant.
13. Modifications
RushTxt may update these Terms from time to time. Continued use of the service constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by the laws applicable to Trcked Up LLC unless otherwise required by applicable consumer protection laws.
